I was told by a friend that when returning from Nepal with H1B visa in your passport, you need to have some short of approval from labor department (Shram Bibhag) of Nepal in your passport or H1B paper works. If you do not have it then they might not let you board the plane.
Does anyone know the truth? Has anyone come back from Nepal with H1B visa and had these kind of issue? What are the requirements from Nepal Government for H1B visa, if there are any?

I was asked to show my Labor certificate when I was on my way back last month. I did not have any, so just persuaded to let me go without any GHOOS SOOS!
be prepared to face awkward situations in the second floor of the airport, while coming back to USA.

On that note, has anyone come back from Nepal a second time on H1B but without Labor Certification? I did my first last winter, and am planning for a trip over Dashain, and I am not too eager to get the letter... _x

Riten, if you are a permanent resident of USA, you do not need visa to come here, so no stamp is necessary on your passport. you can show them your PR card instead of your passport. just my understanding.

Yeah, and you need to show them proof of heath insurance and stuff which will cost you a trip to our infamous "beema sansthan" and pay NRs. 2200 or more and buy insurance. The cost will depend on how long your visa is valid for. Also, the people at the Labor Dept are lazy arse, and will take forever to process your paperwork, unless you tell them your flight is in 3 hours, and they will do it quickly. HTH

I have a stamped H1B from Canada and am going to Nepal soon. My H1 doesnt expire till Sept 2009. Do i still need to get this 'approval' from the labor department? I heard it was only for new H1s who got their visa in Nepal. also, can anyone elaborate what this insurance thing is? can i show them proof of health insurance coverage from here (US)? I'm trying to find more info on this but all i find are this and another thread in Sajha, and nothing else.

If you fly out of Ktm airport you will need this stamp. Be prepared to spend about NRs. 5,000. If you fly out of Delhi airport you will not need one.

If you have H1B stamped from anywhere else but Nepal, then you don't need it (that's what one of my friend who got his stamped in Mexico experienced). However I had to bear hassles in Nepal Airport when I got mine stamped in Kathmandu. Though I made it through with out any significant trouble, I had to endure some unwanted situation. These folks are big on H1B's because there is a possibility for dollar extraction. I went through line by line of that law and felt that it was designed for people going to Gulf. Still an agent for Gulf employment can get these labor permit in whisk no matter what the working conditions for those jobs eventually are. But for Most H1B, who have employee health benefit, prevailing wages, and other strict US regulation have to go and insure with Bima Sansthan and abide other crap. It's time they modify the law, though the law doesn't say any specifics on H1B the broad generic term "foreign employment" encompasses it. There is no provision on the law that states that any one going back to Nepal with prior Labor sticker to get new labor sticker when renewing the H1B for another 3 years. And this labor thing doesn't apply for PR's I would recommend to obtain it if you want to avoid unwanted hassles. But, if possible, make sure none of these suckers get any ghooos during the process of obtaining certification. And, if any one of you have links to any top journalist in Nepal, please ask them to address the issuue if you encounter any during the process. I like the concept of this labor certification to avaoid Nepalese being exploited abroad, but this shouldn't be means for extra income for these suckers.

I had my visa stamped from Canada but they still asked for the labor clearance letter from the Dept of Labor while returning from Nepal this June. I could have shown resistance, but i had made the labor clearance (Rs 3000 total kharcha bhayo) and was in no intention of creating a scene. they don't care where you got stamped, "if you have H1B visa, you must get the labor clearance" seems to be the mantra at the airport. I also inquired about this at the Labor Department, but it seemed that everyone i talked to was a broker who was only interested in my money and getting the letter 'without any hassle'.

I am a non consultancy IT worker in H1B status looking to get the visa in Ktm; My concern is I don't have any insurance or any other benefits just plain monthly salary, but working full time. Anybody who has gone through the government processes, please advise if any adversities I may face while following these paperworks at Labor Dept or Beema sansthan. Thank you
