Congratulations to those who made it.

For those who may not make it,

Another possible option, if the employer is eager to hire you permanently in future is to talk to them about the possibility of filing Labor Certification and initiating a PERM aplication on your behalf. It might take up to 6 months or more to go through the process but still its a better option, IF the employer is willing.

Meanwhile opt for other measures to maintain your nonimmigrant status.

santoshgiri, is this option available only to masters graduates or is it available to undergrads as well. Can you please direct me to a website that has more info. about this PERM?

santoshgiri are you a lawyer? My brother-in-law completed his undergraduate in Computer Engineering from UND this semester. Although he was offered a full-time job by a reputed company, his H1 visa application didn't get selected. If his employer is willing to help him is this PERM thing an option for him? If it is, please let me know. I will ask him to contact you directly. Thanks for the info.

How does PERM Work?

Under PERM, employers will obtain a Prevailing Wage Determination (PWD) from the applicable State Workforce Agency (SWA) and conduct recruitment for the open position. If no able, qualified, and willing U.S. workers, apply for the position, the employer will complete and submit (online or by mail) a detailed form about the job duties, minimum requirements, wages, recruitment efforts, recruitment results, and so on to one of two DOL PERM processing centers. The DOL processing centers will conduct a quick anti-fraud check (to make sure the employer exists and has employees) and if the application is not selected for audit based on unpublished factors or based on random quality control factors, the DOL will certify the application.


I don't think it will work for any computer engineers.

PERM is satisfied by a series of process, starting with placing job offer and employment vcancies in newspapers, website and onsite by the meployer. the employer who wants to hire a person, will place the ads and wait for a month. During this month, any person qualified may apply for the position. It depends on the employer whom to choose!

Generally lawyers play a vital role in the language of the ad. They emphaisze on the unique qualification of the desired employee, making it substantially unaccessable by other applicants based on the language of the ad.

for example -NOT A REAL EXAMPLE.

Software Engineer: Qualification: MSC/BSC/BE/BCS/BCA with XX years of work experience in xxxxxxxx with expertise in the areas of xxxxxxx. Job duites include xxxx(expertise of the person), will be dealing with specifically US, European and South Asian Clientele. Knowledge of at least 3 south languages is a must. US Bachelors Degree preffered.

This allows the person desired to emerge above the other applicants.

Once the person is selected, labor certification is applied with DOL, which in turn certifies the labor over the backlog period. Once certified, the employer can file premiumprocessing of I-140, enabling the employee to work as an immigrant as well as qualifying him to file his green card concurrently.

PERM may be an OPTION if your POSITION falls under EB2 category.

EB3 is backlogged with visa-availability. until this becomes current you cannot apply for concurrent I-140 and I-485 (although you can still hold the priority
date). thus you have to file I-140 and wait for it to be approved.

nepaliketa,
it will be a good option if your position falls under EB2 category.

present DOL requirement strictly prohibits you from using language requirement as a criterion for PERM. you cannot have MS/BS/BE as a qualification.
you have to be very specific like
educational qualification : MSCS with 5 years experience
alternative degrees: MSCPE, MSEE and can consummerate with relevant experience

[ this allows BSCPE/BSEE/BSCS] + 10 years

addendum for more clarification:
untill the visa availability becomes current or matches your priority date your I-485 or your authorization for work will not be APPROVED. THUS PERM IS NOT A WAY OUT
