 how to convince an employer?

Hello all,

Here's my situation. I am graduating in May. I thought I was going to get this job at an insurance company and everything was going fine until they raised question about the H1-B visa, which doesn't surprise me. But the thing is my interviewer was saying how the company has to put up an advertisement looking for US citizens in some local newspaper before sponsoring for me because that is what the law says. Is that true? I am also wondering how widely it is practiced and do people working for certain fields such as computer science are given preference by USCIS while granting those visas. I would also appreciate some suggestions as to how to approach the employer regarding work visa. My interviewer told me that I am the perfect candidate for this job and i am sure he would hire me if I could convince him that sponsoring for me is not a big hassle. Give me sugesstions.....

As far as I know, putting up advertisement in a newspaper looking for US Citizens for the job only applies if the employer is sponsoring you for a Green Card. I believe the law says that if you cannot find US Citizen with a skill set that's needed for the job, an employer might hire an non US Citizen individual who meets those skill set and sponsor their GC. I think that doesn't apply for H1-B's but I could be wrong. You might want to double check that. I don't believe USCIS favors any certain field of study while granting visas.

As for the convincing part, I am not really good at that so I will let other Sajha users give their expertise in this case.

Thank you, Mr. August for your input. I wonder how I can find what the employers need to do while sponsoring me. I will keep looking.. mann, I want that job real bad

Sounds like you have applied to a very conservative company. Apparently it is somewhere in the law but if the company uses Desi lawyer, they usually find a way around it but the local lawyers will insist on following everything to the dot....My sympathy to you as I am suffering similar fate at the hands of gori lawyer with my GC......

Elpida, I dont see any reason why you should remain in the US not your origin country Nepal, where i am right now.

I know our own country is so bad that most Nepalese are desperately leaving to migrate to other countries like the USA, cANADA, Australia, the Middle East and everywhere else where they can find employment and live permanently. Despite our backbreaking labor in the country, people can hardly make both ends meet. Parents think of leaving so they can earn more in other countries, and have their earnings reserved for the education of their children. They prefer to be away and earn much more, rather than earn the pittance wages here, and not be able to save for the future.

I too love Nepal but we are wrong we did get help along the way from many different countries. The Malla empire was great too but it did fall. If we do not stop the invasion of corrupted politicians then our empire will fall. If we do not quit trying to be PC and never offend some people then our empire will fall. The politicians must be held accountable for everything from allowing the degradation of morals to the waste of taxes.

And IF we all young highly educated Nepalese dont go to Nepal after our completion of studies, and dont want to find the oppertunities to build it then we as a country are doomed.

Always remember getting education from foreign universities bring respect when working in your own country.
