 EB-1(A) Visa Question?

Dear sajha users,

Do you have any experience or know anbody who got EB-1(A) category Visa?
If so, could you please share your experience/provide the details that you know regarding the required documents and time period if approved.
Further, does it increase the chance of approval by hiring lawyer or self petition is good enough?

Two clarifications:

1. EB1 category is not a visa category. It is a Green Card petition category.
2. For EB1, you should be an International Award Winner such as Nobel Prize Winner.

Hope, you fall under this category. Good Luck son.

Thanks for clarifications.
I am not claiming that I am a Nobel prize winner. You don't have to be Nobel prize winner to file this kind of petition. There are some other options as well.
I know at least two persons from Nepal who got approved their petition under this category. Unfortunately I don't have their contact information now. So I am just asking Sajha users if somebody has similar kind of experience?

EXTRAORDINARY ABILITY IN
THE SCIENCES, ARTS, EDUCATION, BUSINESS OR ATHLETICS

Extraordinary ability means a level of expertise indicating that the individual is one of a small percentage who has risen to the very top of his or her field.

The following documentation must be submitted to the CIS:

1. Evidence the individual has received a major, internationally-recognized award,

OR
At least three of the following:

1. Recognized prizes or awards for excellence in the field of endeavor. Grants or fellowships awarded to support future work are not considered to satisfy this criteria;
2. Membership in associations in the field, which require outstanding achievement of their members as, judged by recognized national or international experts. Applicants must submit evidence of the organization's membership criteria;
3. Published material in professional or major trade publications or major media about the individual and his or her work in the field. Applicants must submit evidence of the publication's importance (such as circulation). Moreover, the material must primarily be about the applicant, and not simply mention the applicant incidentally;
4. Participation on a panel, or individually, as a judge of the work of others in the same or an allied field. This criteria is not applicable to those for whom judging the work of others is inherently a part of their job duties;
5. Original scientific, scholarly, artistic, athletic, or business related research contributions of major significance in the field. The applicant must demonstrate that his or her work has been recognized nationally and internationally by independent experts as having influed the field as a whole;
6. Authorship of scholarly articles in the field in professional journals or other major media. Applicant must establish that his or her articles are viewed as more influential and important than those of others in the field;
7. Display of the individual's work at artistic exhibitions or showcases. Applicant must establish the importance of the venue;
8. Evidence the individual has had lead, starring, or critical roles for organizations or establishments that have a distinguished reputation;
9. Evidence the individual has commanded a high salary or other high remuneration for services in relation to others in the field;
10. Evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disc, or video sales; or
If the above standards do not apply, the individual may submit comparable evidence to establish eligibility.

Wow! You have certainly piqued my curiosity. If you are or think you are qualified for EB1 category, then you must be an extraordinary gentleman or gentlewoman. I am not being facetious. Please let us know what you have done or achieved? Person of such uncommon talent needs to be celebrated, especially in a small community like ours.

EB1 VISA is issued for people of Australian origin only.

Please check on govt website BEFORE WRITING 'COCK & BULL STORIES'.

I guess it was nothing but some hot air from Miracle. But I truly want to hear about Nepalis who qualify for EB1 category.

EB 1 petition is open to all nationals who has elegible criteria set by USCIS.

Riten,

It's not hot air. I am serious. I have a friend who has filed this petition and let's see what happens. BTW he applied for this petition due to his following achievements:

1. Award from American Physical/Chemical/Biological Society (one of them, I don't want to disclose all the information) for his excellent work in his field.
2. Has Master degree from Nepal as well as US and currently working towards Ph.D.
3. Published at least 10 scientific papers in peer-reviewed journals circulating worldwide.
4. Publsihed 3 articles for his original work as first author.
5. Participated 10 national/international conference.
6. Has awarded with several shorlarship from university (both in Nepal and US) due to his excellent academic achievements.
7. Has more than 3 years of teaching experience in Bachelor level in Nepal.
8. Has reference letters from at least 5 professors/journal editors in his field to recognize his work.
9. His academic advisor has asked US senate (they have very good relation) to endorse his petition as his work is beneficial for that US state where he resides now.

It is really interesting case. Let's see what happens next. I will keep you informed.

Going through the qualifications you listed, I could not find any evidence that he is EB1 material. However, sounds like he might - with emphasis in might - qualify for EB2 National Interest category.

Miracle, my brother got his GC through EB-1(A). I just talked to him and he told me that every requirement to file the petition is on the USCIS site.

Riten, since I like most of your postings, if you really want to clear your doubts about some Nepali that qualified for EB-1(A) catagory, send me an e-mail, and I can give you a little detail about my brother who was qualified for the EB-1(A). If you promise not to disclose his name and anything about him in Sajha, I can give you his name and you can google it (not a whole lot information is available online, though).

hello slack,
Can u please share the information with me too.. i am looking forward to apply on EB1 category. someone mention that it requires 10 publication but it is not mention on the USCIS .. anyway thank you for your infomation.

Miracle and my pride nepal:

My e-mail account for Sajha is temporarily closed so I can't get the messages sent to it. My brother is out of country at the moment and he is not easily reached through e-mails . When I called him, he said every information is listed on the USCIS site, and one can start from there. I also think you can always e-mail the USCIS people?

Do I sound like selfish here? Sorry; while as much as I would like to help you, my brother won't like it if I give you his contact/e-mail information. If you can, try to find the information from the internet or elsewhere, but if there is no way, absolutely no way, you can't find some specific information, please make points and post it on Sajha. I can then try to ask those questions to him and write back his response on Sajha. And, this may take while. Maybe several weeks or even months...

That would be the only help I can offer for the time being because I am not my brother and my brother wouldn't like when his goofy brother gives out his contact address to some people he met on the Sajha! :)

Is there any reason that you have to file with EB1. For nepal, I know there isnt any back log for EB2. With in a year u should be able to get GC going with EB2(dont qoute me on this)

EB-1 Eligibility and Filing

Aliens with extraordinary ability are those with "extraordinary ability in the sciences, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim and whose achievements have been recognized in the field through extensive documentation." You must be one of "that small percentage who have risen to the very top of the field of endeavor," to be granted this classification. For example, if you receive a major internationally recognized award, such as a Nobel Prize, you will qualify for an EB-1 classification. Other awards may also qualify if you can document that the award is in the same class as a Nobel Prize. Since few workers receive this type of award, alternative evidence of EB-1 classification based on at least three of the types of evidence outlined below, is permitted. The worker may submit "other comparable evidence" if the following criteria do not apply:

Receipt of lesser nationally or internationally recognized prizes or awards for excellence;


Membership in associations in the field which demand outstanding achievement of their members;


Published material about the alien in professional or major trade publications or other major media;


Evidence that the alien has judged the work of others, either individually or on a panel;


Evidence of the alien's original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field;


Evidence of the alien's authorship of scholarly articles in professional or major trade publications or other major media;


Evidence that the alien's work has been displayed at artistic exhibitions or showcases;


Performance of a leading or critical role in distinguished organizations;


Evidence that the alien commands a high salary or other significantly high remuneration in relation to others in the field;


Evidence of commercial successes in the performing arts.


Outstanding professors and researchers are recognized internationally for their outstanding academic achievements in a particular field. In addition, an outstanding professor or researcher must have at least three years experience in teaching or research in that academic area, and enter the U.S. in a tenure or tenure track teaching or comparable research position at a university or other institution of higher education. If the employer is a private company rather that a university or educational institution, the department, division, or institute of the private employer must employ at least three persons full time in research activities and have achieved documented accomplishments in an academic field.

Evidence that the professor or researcher is recognized as outstanding in the academic field must include documentation of at least two of the following:

Receipt of major prizes or awards for outstanding achievement;


Membership in associations that require their members to demonstrate outstanding achievements;


Published material in professional publications written by others about the alien's work in the academic field;


Participation, either on a panel or individually, as a judge of the work of others in the same or allied academic field;


Original scientific or scholarly research contributions in the field;


Authorship of scholarly books or articles (in scholarly journals with international circulation) in the field.

Some executives and managers of foreign companies who are transferred to the U.S. may qualify. A multinational manager or executive is eligible for priority worker status if he or she has been employed outside the U.S. in the three years preceding the petition for at least one year by a firm or corporation and seeks to enter the U.S to continue service to that firm or organization. The employment must have been outside the United States in a managerial or executive capacity and with the same employer, an affiliate, or a subsidiary of the employer.

The petitioner must be a U.S. employer, doing business for at least one year, that is an affiliate, a subsidiary, or the same employer as the firm, corporation or other legal entity that employed the foreign national abroad. Definitions of terms relevant to this EB-1 category are found in 8 CFR § 204.5.

Application Procedures

A USCIS Form I-140 (Petition for Alien Worker) is required. All I-140 petitions must be filed at the USCIS Regional Service Center that has jurisdiction over the place where the individual will work. The petition packet must include the required documentary evidence and should follow the specific filing guidelines of the Service Center. No labor certification is needed for EB-1 petitions.

While the EB-1 worker of extraordinary ability may petition for himself or herself, the employer must file the petition for an outstanding professor or researcher and a multinational executive or manager.

Since EB1 is such a hard category to qualify for, I would be hardpressed to believe when any Tom Dick or Harry comes and says he got his PR through that route. But if there is genuinely someone with such qualificatons, I would like to hear about him/her - especially if s/he is in the field of science or social-science.

Correct me if i 'm wrongs but i think saroj khanal , karishmas manamdhar and others did get their GC through EB-1 , entertainment category

That is plausible. I don't know about others but I have also heard Saroj Khanal got his GC through EB-1. Apparently he had a role in a European movie that won some international award which qualified him to be in that category. Impressive!
