Did u email them alltheway ?? how did u get this information. I asked my lawyer and she told me that if u sned your docs(h1bdocs) to kentucky, they should not have to do a PIMS verification in Nepal. She has been wrong before but i will check with her agian. Did the Consulate reply to your email with the answer above

h1Stamping , one of my friend got this respond but again one other friend got his PIMS verified when he emailed his i797 and both the case happened in Sep 09. Seems like they are not consistent with their policy on verifying PIMS via email. I am thinking on whether to email them or not. Let me know guys , if anyone got their verified via email.

I am also planning to get my H1B stamped this winter. Few people are suggesting me to go to Canada or Mexico ( as i live close to the border) and others are suggesting to go to Nepal. I have applied for PERM through my company and waiting for the response. Does it make a difference in stamping if i have applied for PERM? I am directly employed by a small business. Any information will be appreciated.

It won't make a difference. H1B is dual intent visa...If u had applied for 485 then things would have been different.

This might be a good option before you leave.... http://www.uscis.gov/files/form/I-824.pdf [ for USCIS to notify a new U.S. Consulate, different from that originally requested, through theU.S. Department of State's National Visa Center or Kentucky Consular Center about theapproval of a nonimmigrant visa petition or to notify a new Port-of-Entry, different from thatoriginally requested, about the approval of a waiver application. Please notify the U.S.Consulate or Port-of-Entry at:]I haven't got my H1B stamped, but will do this process before i leave!! (its mentioned in our I797 too)!! Planing for Canada or Mexico (Thinking Summer/Winter 2010)

GEDA_GUDI what does the form apply i dont think first time applicants are allowed to get their visa in mexico cananda, or anywhere else except thier own country of origin, does this form apply that we can get it anywhere else,also it has expiration date of 8/31/09.Could you please tell us more about this thanks

By reading various thread about people getting stranded at consulate or embassy because of the unknown status of the applicant encouraged me to read more about this issue. I started with my I-797A (H1-B approval paper), it clearly says "The petitioner may also file Form I-824. APPLICATION FOR ACTION ON AN APPROVED APPLICATION OR PETITION, with this office to request that we notify a consulate, port of entry, or pre-flight inspection office of this approval." I feel this approval does not reflects automatically on various DHS databases (will tell you my story in a while) hence i feel its safer to send this form so they can take necessary action to notify the consulate or embassy. ( don't know what they do and how they function, but its safer to send. Oh we can get H1-B stamped anywhere outside USA, I know many who have received it from Canada and Mexico. My Story: (E-Verify)!! When I was on OPT, my company tried to e-verify my immigration status, DHS's reply was not authorized to work(para-phrased), well I was on OPT and I was working on EAD card ( I had EAD at that time). HR informed me about this, and told me to call 1800 number (DHS number), called them and within 10 min they updated their database. They asked for my EAD card number and I-94 number.(I asked them the reason, as I had EAD card from them.....that guy told me, it takes them time to update the database and may be at times when they ran the e-verify my status was not updated(wasn't updated till the time i called, i started my work this Jan and called them around March end ). My other colleague who was on H1-B faced the same problem, he got it cleared too, his issue was he went home and came back....so his I-94 was not what they have in record. As you know H1-B is associated with I-94. Better safe than sorry, also do more research on I-824, this might help in VISA processing time. All the best.....
