i would like ask suggestions with u all....uknow guys...my one fren is arrested for DWI (driving with intoxication.....drink N drive) and he is in jail right now...he was academically under probation II...that means he may be out of status...and its been 4 dayz he is in jail...some say he may be deported....i m worried of myfren....if u all have any idea plz share with me...i need help

now its been one week still he is in jail. Now he is trasfered to country jail..that is in dallas county jail. i met hi yesterday. he looks tired...and says he is tourtered..and his friends and murderer...criminal..he is still in jail. he told he got a court date on the fifth of june...when we tried to keep some bond to make him out of jail..they didn't let us do that..coz ..they say...he is illegal..actually he is not illegal..but is under probation academically.....his parents don't know bout this...and i m confused how to proceed to lawyers...plz get me this idea...if anyone is in dalls..with this idea.....very urgent!

you need to get a hold of an immigration lawer and tell him/her the situation, its not his dui thats getting him into trouble its his status, normally for a DUI ur kept behind bars for maximum of twenty four hours and then you get a court date, but since his status is messed up they will try to deport him so get a hold of an immigration lawer as soon as possible. good luck.

poor kid ( I am assuming we are talking about a 21-25 yr old here). I know what he did was wrong-- driving under influence is never good, and some very smart idealists in sajha have already shown us than in this thread. But he needs help, and I know he cannot post bail on his own because of his academic probation. There is a nepalese society down there in dallas, and I know some of those guys are very helpful. Please contact them and have your friend taken out under custody of someone else who has a clean sheet and has been here for a while (legally). That should work for now, and then you will need to hire a lawyer to stop him from being deported. Can someone post a link of that society's web page so that score can help his friend?

dont worry, take him out in bail..mostly its 2500-3000 dollar bail amount. he will not be deported if this is his first offence. nothing will happen, tell him to plead guilty in court, his drivinng lisence will be suspended for 3-6 months, and he needs to pay some fines, 1500-2000 dollar, thats it. calm down, nothing will happen. DUI, DWI first offence is very normal. if it is 2nd, or 3rd...its deadliest.

DUI and DWI ARE NOT ALWAYS THE SAME!!! Hope you will learn something today as well.

In VA, NJ they are same. In most other DUI (Driving under influence) is less severe offense than DWI (Driving while intoxicated/impaired). DWI requires blood alocohol content of 0.08 or over, DUI is lesser.

What state was he in? I know some people who were convicted
for DWI in Texas and California. Had to be in probation for 2 years, do some community service and shit. He graduated, and changed his status from F1 to H1 while he was on probation for DWI.

So, I don't see it much of a problem, as long as you hire a good lawyer, and don't start following Paris Hilton's steps. So your friend should be cool.

Alien Student is in 2nd probation.
Charged with D&D (Was he convicted of any felony before?)
Arrested and is in jail.

Arguments:

Does Probation 2nd violate your status? (Hell No. Tons of students go through that stage. As long as he was enrolled in 12 hrs in two long semesters. Even if he were suspended for one semester, he can take summer classes to make it 2 semesters)

Why is he behind the bars for so many days? (Ask a good immigration lawyer. Do NOT go to a DESI lawyer. They barely are able to speak).

Conclusion:

He will get out.

DWI is Driving WHILE INTOXICATED, that is after having 4-5 shots of hard liquor. DWI is a criminal case in many states. So if your friend got caught for DWI, then he better get a good lawyer.
